I don’t want this to turn into the Cuba and Lessig blog, but I’m in the middle of final exams and my distractions are limited. So anyways, I just started reading Free Culture and noticed that both in the dust jacket and in the “About the Author” page in the back of the book, the little bio notes, among all his accomplishments, that Lessig clerked for Judge Richard Posner of the 7th Circuit–arguably the greatest living jurist today–but it doesn’t mention Justice Scalia. Huh. In fact, Lessig clerked for Scalia in 1990-91. You’d think he’d mention a little thing like that. Is this a calculated slight, an oversight, or just elitist shame?

UPDATE: The answer came on page 246. Lessig is very upset at Scalia for voting against him in Eldred. He likens it to a punch in the face.

And here I got all excited and thought you managed to post an entry that involved BOTH Lessig and Cuba.

During the last presidential campaign, Pat Buchanan said that, when faced with Supreme Court appointments, he would appoint eight more Scalias to the bench.

    I would have to disagree.

If I were President, I think I would instead appoint eight more Thomases to the Court.
